TERMS & CONDITIONS

Products

Some Products, Flowers and Plants may be harmful or poisonous, if you require further information before submitting an order please contact us by emailing info@flowersido.com

All products are subject to availability. In the event of any supply difficulties, we reserve the right to substitute with a product of equivalent value and quality without notice.

In the event that we are unable to supply all or part of your order (the product or any substitute product to you at all), we shall notify you as soon as possible and reimburse your payment in full no later than 30 days after the intended delivery/collection date.

Payment

We accept payment by Paypal and all major credit and/or debit cards, other than Diners, department store cards and any other credit and/or debit cards as we may specify from time to time. However, wedding payment can only be accepted by bank transfer (BACS).

Submitting your order is subject to our acceptance of this offer. We will send an email confirmation of your order details to advise that we are processing your order via the email address you provide. We will not consider ourselves bound by a contract with you until we have issued this email confirmation.

Wedding payment and cancellation

No wedding or event is booked until the deposit has been paid. Quotes are valid for 30 days. Once the deposit has been paid then the prices and dates are secure unless stated otherwise.

The balance is due 6 weeks prior to your wedding date. If you fail to pay your balance by the required date, we reserve the right to cancel your order and in the event that another major event wishes to book for that day, they will take priority if a deposit has been received from them. Payment is accepted by bank transfer.

As we are limited to the amount of weddings we can fulfill on any one day, a non-refundable deposit of £100 is required in order for you to secure the day.

If you decide to postpone your wedding we can hold your deposit until your wedding goes ahead. The £100 deposit is subtracted from your final wedding invoice. If you have paid the balance in full and decide to cancel outside of the 21 day period before your wedding, we will issue a refund minus the deposit. If you cancel within the 21 day period, we reserve the right not to issue a full refund. Your flowers will be ordered 14 days prior to your wedding date and as such, cancellations that fall within the 14 period prior to your wedding date will not receive a refund. If you cancel in the period 21-14 days prior to your wedding we will refund 50% of the balance, less the deposit.

Equipment hire/use of equipment
A refundable deposit of £100 is charged for this service. Containers must be returned to Flowers, I do within 5 days, or as otherwise agreed.

Charges will be made for any equipment returned cracked, chipped or broken. Replacement of goods is charged at the current purchase price. It is the responsibility of the hirer to reclaim any of these costs from the venue if the venue was at fault.

Equipment hired or borrowed from Flowers, I do remain the property of Flowers, I do at all times.

Delivery

In case of delivery to certain locations where a third party is involved, such as offices, hospitals, airports, hotels, ships and other business locations, the signature of any person authorised to accept delivery on behalf of the organisation shall be accepted as proof of delivery to your chosen recipient.

Please note that not all hospitals can take delivery of flowers. If you wish to send flowers to a hospital please telephone in advance to check they can do this.

Please note that we are only responsible for delivering against signature to the address you quote (or an imminent neighbour if no one is at home) we regret that where goods have been correctly delivered we can not accept responsibility if the intended recipient has moved, or lives elsewhere, and the actual received refuses or fails to return item(s).

In the instance of there being difficulties in delivering your order to the intended recipient we reserve the right to contact the recipient using the contact details you provide on the Order Form.

Cancellation or amendments

You are entitled to cancel any payment at any time where fraudulent use has been made of your credit or debit card by another person not acting on behalf of you or as your agent and to be re-credited by us to the extent that such sums are not reimbursed by the card issuer in such circumstances.

If, for any reason, you wish to cancel or amend your order you can do so, by calling 07402887098 or emailing: info@flowersido.com.  Please give 48 hours notice before the requested delivery date.

We regret that you may not cancel an order for: (i) perishable goods once your order has been dispatched; or (ii) customised goods, i.e. wedding and events flowers, if as at the time you seek to cancel, the customisation process has begun =within 14 days of the event.

Data protection/privacy

Our policy is to respect the privacy of all customers. We will not monitor, edit or disclose any personal information about you or your accounts, including its content without your prior permission, unless we are required to do so to conform to legal requirements or comply with legal process.

We shall ensure that we comply with the requirement of all current data protection legislation including, without limitation, the Data Protection Act 1998 (as replaced, modified or re-enacted from time to time). We shall only use personal data received from you for the purpose of fulfilling our obligations under these Terms & Conditions.

Accuracy of content

We take every care to ensure information on this site is accurate; however some prices or details shown on the website may change from time to time and it is possible that errors will occur. We will endeavour to rectify any errors as swiftly as possible. Should an error occur you will be given the option of either (a) confirming your offer to purchase subject to the correct description or price or (b) retracting your offer and receiving a refund if the goods have been paid for.

Rights

All rights, including copyright, in this website are owned by or licensed to Flowers, I do. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission.

Law

This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contact agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

Links to websites

Our website may contain links to other websites of interest. However, once you have used these links to leave our site, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information which you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

Photographs

Flowers, I do reserves the right to take photographs of flowers and the setting prior to the wedding which may be used for promotional purposes.

General

We reserve the right to supplement and amend the Terms and Conditions on which you are permitted access to the Flowers, I do site and/or the Flowers, I do service from time to time. We will post any changes on the Flowers, I do site and it is your responsibility as a customer to review the Terms and Conditions on each occasion you access the Flowers, I do service or Flowers, I do site. Changes will be effective five hours after the posting of any such change and all subsequent dealings between you and us shall be on the new Terms and Conditions.

Additionally, we reserve the right to suspend, restrict or terminate access to the Flowers, I do site and/or the Flowers, I do services for any reason at any time.

These Terms and Conditions shall be deemed to include all other notices, policies, disclaimers and other terms contained in the Flowers, I do site, provided that in the event of a conflict between any such other notices, policies, disclaimers and other terms, these Terms and Conditions shall prevail. If any of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

A person who is not a party to the agreement between you and us has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the Terms and Conditions but this does not affect any right or remedy which exists apart from that Act.

In respect of fraudulent misrepresentation, this agreement (including any documents and instruments referred to herein) supersedes all prior representations, arrangements, understandings, and agreements between you and us (whether written or oral) and sets forth the entire agreement and understanding between you and us relating to the subject matter hereof.

Your purchase will be deemed to have occurred in the UK if the delivery was to an address in the UK. In the event of a delivery to an address in the UK, these Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English courts

Circumstances beyond our control

Adverse weather conditions

During adverse weather conditions (including but not limited to heavy snow, ice, flooding or high winds), our delivery partners may not be able to deliver orders on time. This is outside of our control and we cannot accept responsibility for the late delivery of the order. Therefore, in the event of adverse weather conditions, we aren't able to refund or offer re-delivery of affected orders.

Force Majeure

Flowers, I do shall not be liable for delay in performing or for failure to perform its obligations if the delay or failure results from any of the following: (i) Acts of God, (ii) outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) the act of any government or authority (including refusal or revocation of any licence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v) power failure, failure of telecommunications lines, failure or breakdown of plant, machinery or vehicles, (vi) default of suppliers, sub-contractors or delivery partners, (vii) theft, malicious damage, strike, lock-out or industrial action of any kind, and (viii) any cause or circumstance whatsoever beyond Flowers, I do’s reasonable control.

Our liability

Whilst we agree to use all reasonable endeavours to ensure that the Flowers, I do service is fully operational and error-free we cannot guarantee this and, therefore, accept no responsibility for any interruption of the Flowers, I do service and shall be released from our obligations under these Terms and Conditions in the event of any cause beyond our reasonable control which renders the provision of the Flowers, I do service impossible or impractical.

We accept liability for death or personal injury arising from our negligence.

We accept liability for fraud or fraudulent misrepresentation.

Our liability in contract, tort (including negligence and breach of statutory duty) or otherwise arising by reason of or in connection with your order with us shall in no circumstances exceed the price paid to us for the order in question.

We exclude all liability for any claims, losses, demands and damages, including without limitation, any costs, loss of profits, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Flowers, I do service, whether arising in contract, tort (including negligence), under statute or otherwise PROVIDED THAT nothing contained in these Terms and Conditions affects or will affect your or the recipient's statutory rights in relation to the quality, fitness or description of the products supplied.
